Welcome to Sportspowerplay Gym. This User Agreement ("Agreement") governs your access to and use of our gym facilities, website, and services (collectively, the "Services"). By using our Services, you agree to these terms. If you do not agree, please discontinue use immediately.
Acceptance of Terms
By signing up, you acknowledge that you have read, understood, and agreed to this Agreement, our Privacy Policy and Cookie Policy. Your continued use constitutes acceptance of any modifications.
Definitions
  • "Member": Any registered user of Sportspowerplay facilities.
  • "Services": Gym access, fitness classes, personal training, and digital platforms.
  • "Personal Information": Data including name, contact details, and health metrics.
  • "Force Majeure": Events like natural disasters affecting service delivery.
Cookie Policy and Online Tracking
Cookies enhance user experience and enable analytics. Adjusting browser settings to refuse Cookies may limit functionality. See our Cookie Policy for details.
Membership Eligibility
Minimum age: 16 years (under 18 requires guardian consent). Medical clearance may be required for high-intensity programs.
Membership Plans & Payments
  • Fees are non-refundable except under statutory rights.
  • Auto-renewal subscriptions require 30-day cancellation notice.
  • Late payments incur 5% fee or membership suspension.
Gym Access & Conduct
  • 24/7 access for premium members only.
  • Prohibited: Misusing equipment, aggressive behavior, or recording others without consent.
Health & Safety
  • Train at your own risk. Disclose pre-existing conditions to trainers.
  • Wipe down equipment post-use; athletic attire required.
Personal Training
  • Sessions expire 60 days from purchase.
  • 24-hour cancellation policy; no-shows forfeit session.
Class Bookings
  • Reserve via app; late arrivals (>10 mins) lose spots.
  • Unlimited classes exclude specialty workshops.
Freeze Policy
Members may freeze membership once/year for up to 2 months (medical notes required beyond this).
Privacy & Data
  • Biometric data (if collected) is stored securely per GDPR/CCPA.
  • Media taken onsite may be used for marketing (opt-out in writing).
Intellectual Property
All workout plans, logos, and app content are copyrighted. Commercial reuse prohibited.
Liability Waiver
We are not liable for injuries sustained during training. Members assume all risks.
Termination
  • We may revoke membership for violations (e.g., harassment, unpaid fees).
  • No refunds for terminated accounts.
Force Majeure
Fees may be adjusted or facilities closed during emergencies (credits issued where applicable).
Dispute Resolution
Disputes resolved via mediation in Nebraska, USA. Arbitration if unresolved.
Indemnification
You agree to cover costs if your actions cause harm to others or our property.
Amendments
Changes posted onsite/app; email notifications for major updates.
Entire Agreement
Supersedes all prior agreements. Policies are non-negotiable.
